You might have noticed that some cell towers are illuminated while others are not. This can be observed while driving, walking, or even if you have a cell tower lease on your property.

The FCC has been given the authority by Congress to require the painting and/or illumination of antenna towers when it determines that such towers may otherwise constitute a menace to air navigation. 47 U.S.C. § 303(q).

The FCC always requires an FAA determination that an antenna tower will not pose an aviation hazard before it will grant permission to build that antenna tower. Information required on the FCC construction permit form advises the FCC staff as to whether such a tower location or height is involved. The FAA's determination takes into consideration the location and height of the proposed tower, and its safety lighting and marking.

Following the signing of a cell tower lease by a landlord, the tower builder commences due diligence. This process includes a submission to the Federal Aviation Administration (FAA) for a recommendation.

Per the FAA, In general any temporary or permanent structure, including all appurtenances, that exceed an overall height of 200 feet (61m) above ground level (AGL), or exceeds any obstruction standard contained in 14 CFR Part 77, should normally be marked and/or lighted.

Additionally, cell towers within flight paths or otherwise designated by the FAA may require lighting, even if they are under 200 feet tall. Height restrictions are common near airports. Tower developers often construct towers between 195 and 199 feet to avoid the mandatory lighting requirements, which add to operational costs and can be a compliance risk. Furthermore, residents and communities often object to the visual impact of illuminated towers at night.
